Disclaimer

This disclaimer explains what TworkX is for and what it is not for. It forms part of the Terms of use. Please read it before relying on anything TworkX produces.

What TworkX is

TworkX is a construction tool. It helps a site team take the information it has about a piece of temporary works (the site, the ground, the loads, the staging, the constraints and the people involved) and transfer it to the temporary works designer as a design brief. It checks that the information entered is complete and consistent against a library of rules, draws figures from that information, proposes risk categories for the author to decide, and prints the brief for the author to review and issue.

What TworkX does not do

TworkX does not design temporary works. It does not check designs, does not assess whether any excavation support, formwork, falsework, scaffold or other temporary works is adequate, and provides no design certification, approval or sign off of any kind. It does not size members, work out capacities or set design loads or pressures.

Where a brief shows a calculation, such as the full hydrostatic head of wet concrete or the bearing pressure under an item of plant, it is indicative only. It is printed with its formula and inputs as information for the designer, and it is not a design value.

TworkX does not give engineering, legal or other professional advice, and using it does not create a professional engagement with us.

Who is responsible

Everyone involved in the temporary works keeps every responsibility they have under the law, their contracts and their organisation's procedures. TworkX takes on none of them. In particular:

  • the author of a brief, and their organisation, are responsible for the information in it and for deciding the categories, the responsibilities and anything the tool proposes;
  • the temporary works coordinator is responsible for the coordination and the checks their procedures require before the brief is issued and before the works are used;
  • the temporary works designer is responsible for the design and its basis, including any values taken from standards or the ground investigation, and for asking for any further information the design needs;
  • the design checker is responsible for the check of the design; and
  • each person conducting a business or undertaking keeps their duties under the work health and safety laws.

Check every output before you rely on it

Everything TworkX produces must be checked by a competent person before it is relied on or issued. That includes the brief and its tables, the figures, the proposed risk categories and check category, the responsibility matrix, the open items, the scaffold component take off and materials list, values proposed by Auto solve or carried from templates and other briefs, values read from documents, and AI explanations.

  • The gap check tests the information against the rules in the library. It finds only what its rules look for, so a brief that passes the check can still be incomplete or wrong for the works.
  • Figures are drawn from the information entered and are not drawings for construction. Members a designer will size are shown as indicative.
  • The scaffold component take off is a budget quantity list worked out from stated rules. It is not a design or an order, and it does not show that the components will suit the scaffold.
  • Values read from a document are proposals. They count as missing until the author confirms them, and the author is responsible for checking each one against the document.
  • AI explanations are general guidance about a question in the library. They can be incomplete or wrong, and they never decide whether anything is adequate.

Standards and other documents

TworkX cites standards, codes of practice, regulations and guidance by reference only. It does not reproduce them and does not replace them. You need your own access to the documents you rely on, and you must confirm which edition applies to your project. Values you take from your own copies and enter into TworkX, such as the ground parameters in your parameter table, are your responsibility.

A document being cited by TworkX does not mean its publisher, or any industry body, has reviewed or supports TworkX.

The demonstration and the sample brief

The demonstration and the sample brief use a fictitious project. They show how TworkX works and must not be used for real works. Exports from a demonstration account are marked DEMONSTRATION ONLY, and exports made during a free trial are marked TRIAL.

Your rights under the Australian Consumer Law

Nothing in this disclaimer excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or changed.

To the extent the law allows, we are not liable for loss or damage arising from reliance on TworkX or its outputs without the checks described above, from the design, construction, use or failure of any temporary or permanent works, or from information entered by you or by others. The Terms of use set out the limits on our liability in full.
